Obito wasn't taken by Madara after giving his eye to Kakashi, but was dug up from the fallen rocks and remained a Leaf Shinobi. The Uchiha clan wasn't killed and remains the Leaf police force. Sadly the Nine tails attack still happened and Naruto became the Jinchuriki after losing his parents.
