Tom Marvolo Riddle had also been caught, and look where he ended up. All Dumbledore had to do, was mention horcrux in Tom's presence, and Tom naturally would not want to die. It was for the greater good of humanity that the be would be locked up in Azkaban. Of course, Dumbles concocted a reason why Harry should be imprisoned. After all, he did cast unforgivables.
