Either way, Draco is not given many choices, it is either infiltrate Hogwards to spy on that idiot Dumbledore or torture, and Draco would very much prefer not to be tortured. Not to mention, he hates Dumbledore anyways. It is not as though he minds the task....thought...it is quite tedious really.
