Sasuke Uchiha was to be sentenced to death for his actions against Konoha, and his betrayal to his teammates: and there was nothing anyone could do to change the minds of the council that made the decision.
Kakashi made one last rash decision that would effect the team that he once lead, and would change the lives of two of them who would no longer be allowed to set foot on Konoha grounds again until Kakashi could assure them that they wouldn't be killed for the decision Kakashi made.
