In Indian democracy, it is proudly, faithfully and substantially written in the Indian Constitution that Indian Democracy stands on 3 pillors that is Executives, Legislation and Judiciary. But if you make a microanalysis of the practical facts of impediments to justice in this country is the Legislation itself. In other words, Too much of new legislations and various amendments in all laws creates tremendous complexity in application of provisions of laws in any matter in point of law as that point of law could have a referral in many other laws that might cause the difficulty in deciding the case with absolute judicuious acumen.
This may unfortunately serve to be an obstacle in the process of delivering true justice. This is because, courts are bound by the laws made by the legislative bodies and cannot go beyond the laws to decide any case. So, as every year hundreds of laws and amendments are made and many laws are interdependent. There will be a time when Judiciary will collaps because of the piling up of legislations and the courts will be lost in the network of complexities of various legislations creating the possibility of errornous judgements. Hence, inadvertently courts will be disfuntioning as an instrument of delivering absolute justice and would merely become a useless tool in the hands of Legislation and Executives to mend the judiciary at its terms and powers. If this happens, people of India will have no faith in Judiciary which would cause a failure of democracy in India. And this downfall of democracy has already begun.
