Sumario: -1.° El hecho de darse por contestado la demanda en rebeldía del demandado, no atribuye a este la prueba que corresponda producir al actor.

2.° La confesión á que se refiere la Ley I, til. 4, lib. 4, R. C. solo produce el efecto de dar por contestada la demanda, trabajando así la litis contestación, y dejando la causa conclusa, bien para prueba, Bien para sentencia según fuere su naturaleza, y debiendo dictarse aquella, según corresponda en justicia.

3.° Las disposiciones del Código Civil no son aplicables a los procedimientos judiciales.
