2¬ INSTANCIA. Buenos Aires, mayo 20 de 1977. Considerando: El art. 166 del cód. procesal establece que "pronunciada la sentencia, concluirá la competencia del juez respecto del objeto del juicio y no podrá sustituirla o modificarla salvo los supuestos que menciona luego la norma citada-. Esta es de aplicación tanto en la primera como en la segunda instancia, y abarca supuestos como el de autos, en el que se invoca "error sustancial en la decisión" (conf. Fassi, t. I, p. 304, parág. 57).
