FGL Rule Explained and Possible Changes
The FGL rule limits citizenship by descent to the first generation born abroad. If Bill C-71 is approved, this could change. It might then include a second-generation limit. This would mean more foreigners could get citizenship through their Canadian parents.
On June 19, 2024, IRCC will address the FGL rule changes from the Ontario Supreme Court. Until then, some can get citizenship faster.
Who Benefits?
IRCC's quick measures help those who applied for citizenship and were affected by the FGL rule. It applies if they asked for urgent processing in two situations:
1. First Situation: An applicant with a citizenship proof application affected by the FGL rule asks for urgent processing.
2. Second Situation: An applicant's proof of citizenship is delayed due to the FGL rule and then asks for urgent processing.
IRCC checks if the request meets urgent processing criteria. If it does, the applicant learns the FGL rule still applies. Then, they can ask the Immigration Minister for citizenship.
Urgent Processing Eligibility
To get urgent processing, applicants must show a need for key benefits like:
1. A pension
2. Healthcare
3. A Social Insurance Number (SIN)
4. Employment proof
Travel needs due to a family emergency also qualify.
IRCC warns that urgent processing does not guarantee quick receipt of the certificate.
