The Malfoys are ALL in Azkaban awaiting the Dementor's kiss. Draco is scheduled to receive said kiss on his 18th birthday which is in a few months. 
One day, ALL of the Malfoys are pulled out of their cells and pulled into a room, like the one Harry was in at his trial in 5th year. 
They all assumed that their Dementor's kiss date was moved up.

However, it wasn't. They had been found innocent in a trial that was held without their knowledge. Thanks to the new Respectable Auror-in-training, who may not have pulled a few strings, Harry Potter, they are let out of Azkaban and sent to the Manor. They are given their wands back with many crazy restrictions from the Ministry.
As an Auror in training, Harry Potter has to monitor them as a test in order to become an Auror, while also simultaneously attending school for his last year.

As part of his 'House Arrest Sentence' to stay out of Azkaban indefinitely, Draco has to return to Hogwarts for his redo 7th year - 8th year.
