this story is but another in a long line of my personally made Batman universe, that takes place in the 1800s-1900's. Batman is considered a supernatural myth in Gotham, and most villains don't believe in him until they're met face to face.
in this version, Scarecrow was a German scientist that had fled the country rather than participate in operation paperclip
