He's not physical form yet... it's more like a ghost like the dead army in return of the king. He's kind of like a beautiful illusion. He can touch others and others can touch him but he's a ghost. So... he turns his eye to Legolas and starts tricking him. He has an eye for Legolas body to make his own.
