This process, however, comes with its own potential downfalls. Luckily, in the vast majority of cases, they can be avoided.
Selecting the Mediator
The opposing party's first choice regarding the identity of the mediator should not be set in concrete. While the process can take some time, it's important to make a sound decision based on the gathered facts. An attorney should not be afraid to ask around about the personality, and potential affiliations of the mediator. These factors ultimately determine if they can remain impartial and be the essential element of the case that they are supposed to be.
A Good Attorney Is Always Ready
It is important to be prepared during the mediation. The mediation process will offer the first glimpses into the eventual decision. Potentially having such predictive power, the mediation can determine the outcome of the case sooner than many would think. This is not the only reason that being ready for it should always be a goal of the attorney. Since the presentation can be crucial for potentially reaching a settlement further down the road.
Keep the Bottom Figure
Not sharing the bottom figure - not even with the mediator - prematurely, serves its own purpose. By spilling the beans too early, one can assume that the figure is in fact not actually the bottom one, but one that could still be lowered as the case progresses.
The Client Could Wait Outside
Some mediators will insist that the plaintiff should be in the court room, but that's not always the best idea. They are much more emotionally invested than anybody else there, and that can definitely lower the chances of any settlement.
