DAVID BURKE HEARING/TRIAL
Honorable Judge Kate Williams listened to opening statements from both the prosecution and defense over the past few days. Derek Harrison (District Attorney) has been trying to prove that David Burke is guilty of the crimes he is being accused of. The Defense Attorney Ashley White is going to try and discredit the victim, in order to prove her client is innocent.
However, the evidence against David is overwhelming. Between the medical reports and police reports that were found on the flash drives. As well as the digital recording of David admitting and planning to kill Isabella and the murder of her parents.
In the last several hours, the Honorable Judge Kate Williams heard testimony from several of the people of the people on the prosecution list. Like the sheriff and chief of police from Greenwood. The FBI agent and the state detective were involved with solving the murder of the Fremont's. The two officers from Fairville, as well as three other witnesses from the tavern. The last person to testify was Isabella.
"Please call your next witness, Mr. Harrison." Judge Williams stated. There was only a major issue with that and only hoped that the judge would understand.
"Your Honor, I would like to address the sensitive nature of this case and the profound effect it has had on the defendant and his family, while maintaining the utmost respect for the court's authority." Derek stated. "The witness is not at ease with the prospect of confronting the defendant during this time."
"Then she shouldn't have filled these bogus charges against my client, Mr. Burke. I move for the charges to be dropped since the prosecution can't prove their case. They have no proof without their star witness." Ashley said.
"Objection!" Derek said.
"Overruled. Don't worry, I agree with your frustrations, Mr. Harrison. Now, Ms. White that was out of line and motion denied. Mr. Harrison, is there a reason she doesn't want to face the court today?" Judge Williams asked him.
"Yes, she is till traumatized from everything that happened to her while Mr. Burke had her in his care. Then Mr. Burke's mother, Selina, followed Ms. Fremont and Mr. Stone through the West Avenue Park and into Sweet Heaven's ice cream shop. She confronted Isabella and threatened her. As you can see in exhibited 12-B through 14-H that you have in front of you are pictures of the incident. As well as the audio print out from the security camera from Sweet Haven.
"Objection." Ashley stated. Judge Williams finished looked at the evidence that was presented to her by the bailiff.
"Overruled. Mr. Harrison. Has the evidence to support his case. There for I deny your motions, Ms. White." Judge Williams state. Ashley looked pissed. "Bailiff Copper, please return Mr. Burke to his cell."
"Yes, your honor." Bailiff Cooper said. He walked over to David and escorted him out of the courtroom and to his cell.
"Ahh, Chief Stone, you are in my courtroom today." Judge Williams said.
"Yes, Your honor. I hope that is not an issue?" Chief Bradley said.
"No, not at all. But there was an incident that happened in your jurisdiction. Do you recall one with Mrs. Burke and Isabelle Fremont?" Judge Williams asked.
"Yes, my son and Isabella told me about it. But she was too scared to press charges." Bradley said.
"Well, she is not the one filling them. I am, so please, place Selina Burke under arrest for intimating a witness, assault, terrorist threats, and stalking." Judge Williams said.
