Lemme explain the situation. So, as you probably know, Hatter is a wanted criminal in at least 4 states. He's gotten into fights with the police before, and escaped them mostly unharmed due to his good aim and focuse. But, this Time it was diffrent. He got distracted. The police took the opportunity and shot him. What did he get distracted by? Cheshire. Cheshire showed up to check on him, and this distracted Hatter. His last words are "I'm sorry, but I'm going to have to break my promise" Because he made a promise to Cheshire that he would never do anything to hurt Cheshire.

The reason he's not wearing his jacket or Hat is because he took off his jacket for the fight since it's actually quite heavy and his hat fell off during the fight.
