Sex and gender, two terms that are commonly misunderstood to be the same. Nevertheless, while 'sex' of a person refers to the assigned biological identity of a person at birth, 'gender' is an emotion, a tradition and a stereotype that society has created over the time and has deemed appropriate for the sexes to follow.
However, there maybe people who feel a persistent disconnection and internal denial towards the sexes assigned to them. They either associate themselves as neither of the sexes, mixer of the sexes or of the opposite sex. The umbrella term that has come to define these people is "genderqueer" and those who associate themselves with the sex opposite to their assigned sex are termed as "transgender". Often, it is common misconception that being a transgender originates in the mentality of a person, it is often seen as an mental disorder. But, that is not the case. It is an identity. Identity of a person is the understanding of oneself; the acceptance of of one's existence and knowing the principles of it.
It is a common misconception that being transgender is a mental disorder and that remains a common stereotype. Nevertheless, it is a persistence and authentic disconnect that one feels. It is not something that can be treated. Professionals often term it as "gender dysphoria" and it can cause distress and pain in the lives of transgenders. Many transgenders can undergo transition without medical intervention while some have no desire to pursue it. Whereas, there are many who cannot afford a transition to their desire sex and continue to face discrimination for who they are. Moreover, it is also common stereotype for a transgender to be a homosexual. It is rather untrue. While being a transgender is one's gender identity, being homosexual is one's sexual orientation.
The rights of Transgender persons bill was passed in 2014 which seeks to end discrimination that they face.Thus the first and foremost right that they are deserving of is the right to equality under Article 14. Article 15 speaks about the prohibition of discrimination on the ground of religion, race, caste, sex or place of birth. Article 21 ensures right to privacy and personal dignity to all the citizens. Article 23 prohibits trafficking in human beings as beggars and other similar forms of forced labor and any contravention of these provisions shall be an offence punishable in accordance with law.However, that doesn't save them from people looking down upon them, in work and outside. Several times, transgenders haven't been given a voter ID due to the confusion of putting them in male and female category. Adoption rights have only been granted to transgenders legally in Kerala and Tamil Nadu states of India.
Through the history, humans have developed a civilisation and named it as society. In addition, we have followed the rules and norms of something which was formed in order to build a civilisation and have taken in as fundamentals of nature. However, if with time human beings change, so does their level of intelligence. It is the identity that humans build for themselves that differentiates humans from animals. That is why, humans have something known as 'identity' and if the one is termed as mentally defective when one doesn't identify oneself with something they are born with and we are striping them off their identity; how does that differentiate us as a species? How does one define something as unnatural? If something exists then it's because the nature allows it to; it is a gift of nature just like the rest of us.
