It was the first day of the custody hearing. Sawyer was staying with Bucky's grandma. The judge came into the courtroom.
"Okay..so lets get started Mr Barnes what is this case about?" Judge Hill said
"My client would like full custody of her two year old daughter Sawyer James Burkhart. I have countless evidence that proves that the defendent has failed to do anything that their original custody agreement required of him." Carter said
"Okay well lets get started. Who is speaking on her behalf." Judge Hill said
"Her current boyfriend James Barnes. He has been around since the beginning and even before that." Carter said as Lucas rolled his eyes.
"You may proceed." Judge Hill said
"I call James Buchanan Barnes to the stand." Carter said
The guards let Bucky in he got sworn in and took the stand. Judge Hill said "Mr Barnes.. I want you to tell me and the court how you know Ms Tatum and Mr Burkhart."
"I have known Ms Tatum since kindergarten when she moved next door to me. And I met Mr Burkhart during our senior year of college when Ms Tatum introduced us." Bucky said
"Okay.. so its safe to say that you have had a very long friendship with Ms Tatum." She said
"Yes your honor." Bucky said
"Now tell me about the day that Ms Burkhart was born. Because according to your brother's evidence. You were there that day." Judge Hill said.
"Ms Tatum called me at 3 in the morning in tears. She was in labor and Mr Burkart was no where to be found. I rushed to her place rushed her to the hospital. I kept trying to call him for her but he still wasn't answering his phone. I stayed by her side I held her hand as she pushed her daughter out into the world. I cut the cord Im the first person that got to hold Sawyer. He didnt show up till three days later." Bucky said
"Thank you Mr Barnes. Now according to you. You and a long list of others have had to pick her up on more than one occasion when Ms Tatum has had plans and its his weekend." Judge Hill said
"Yes your honor." Bucky said
"She takes ballet and gymnastics. Does he show up for those competitions and recitals?" Judge Hill said
"No your honor. Its me our friends Ms Tatum and her parents and my family." Bucky said
"Does Sawyer ask why he didn't come?" Judge Hill said
"No..in fact her first word was mama. And when she did learn the word Dada she only said it to me. She would cry when he would show up for his weekends." Bucky said
Judge Hill shook her head.
"Is it true that Ms Tatum turned down the dance coach job she was offered?" Judge Hill said
"Yes. She turned it down cause she never knows what his plans are last minute. Mr Burkhart waits till the last second to say he is not coming." Bucky said
"Your brother has also let it be known that you told him about some things that she does not know about or has yet to bring attention to.Go ahead and let those be known." Judge Hill said
Bucky swallowed hard. "He has caused her to have two miscarriages after being abusive in the beginning of their relationship. Mr Burkhart stalks her apartment I have seen him drive by on a few different occasions. He has clearly been to the window when he calls to ask why Im there." He said
"You may step down." Judge Hill said
"Thank you your honor." He said
He sat down behind Mckenna. Judge Hill read over all the child support documentation. "Okay. So as far as I can tell Mr Burkhart it doesnt look to good for you. Do you have anything to say for yourself?" Judge Hill said
"I would like to sign my rights over to my ex wife. I never wanted kids so she can have her. I dont want to pay for a kid. She probably isn't even mine anyways." Lucas said
Mckenna looked down and shook her head. "I never cheated on you. That was your doing." Mckenna said
"Order.." Judge Hill said
Mckenna wiped tears "Before you sign your rights away Mr Burkhart would you like a DNa test done? If it comes back that you are not her father Ms Tatum will have to pay you back for the child support you did pay." Judge Hill said
Mckenna gasped.
"I would like to do that. I want James tested too." Lucas said
Bucky balled his fists up.
"Okay court will reconvene in the morning. Ms Tatum Mr Barnes you are to report to the lab with Sawyer. Mr Burkhart you will wait till they are done to avoid confrontation." Judge Hill said
They went to the lab once they got Sawyer. Mckenna wiped tears as Bucky held her hand. "Mama sad Buck Buck sad.." Sawyer said
"Its been a bad day baby." Bucky said as he threw his tie in his floor board at the red light. He reached over and grabbed Mckenna's hand.
They arrived at the lab they did a swab of Sawyer's mouth and Bucky's. Lucas came in an hour later and had his swab sample taken.
