ACT FOUR

INT. COURTROOM - MORNING

As a VIDEO PLAYS, Spencer nervously glances back at Olivia's empty spot on the bench. The video shows Spencer pulling Derrick away from Olivia. He PUNCHES him over and over. Enraged, Spencer doesn't hear Olivia's pleas to stop. TWO BYSTANDERS pull him off of Derrick and the VIDEO STOPS.

The lights come back on and the room BUZZES with MURMURS. Spencer shifts uncomfortably in his seat. Ray gloats nearby.

JUDGE

Order in the court!

The murmurs subside.

ATTORNEY WALKER

This video clearly shows Mr. James' proneness for violence and raises serious concerns about whether he is fit to care for Destiny and Tianna.

ATTORNEY SULLIVAN

Your honor, this video is just a calculated ploy by Mr. Walker to discredit my client.

(scoffs)

This edited version does not show the full scope of the incident. Mr. James was protecting a friend from an abusive ex-boyfriend. Who I might add was arrested at the scene. Mr. James was not charged.

Olivia walks in and slides a note to Attorney Sullivan.

ATTORNEY WALKER

Your Honor, Mr. James' intentions may have been noble. However, his violent actions show poor judgment and lack of control. It took two bystanders had to intervene.

ATTORNEY SULLIVAN

On the contrary, Your Honor... It highlights his willingness to stand up for others and protect those in need as he's done for Destiny and Tianna since birth.

Attorney Sullivan looks up from the folder.

ATTORNEY SULLIVAN

Furthermore, we'd like to present another witness. Alisha Thomas. Destiny's birth mother.

Stunned Spencer's eyes shift from Attorney Sullivan to Olivia. She avoids his gaze. 

JUDGE

I will take everything I've heard into consideration... Court will reconvene on Tuesday.

The judge BANGS the GAVEL and the court adjourns.

INT. SLAUSON CAFE - DINING AREA - AFTERNOON

Emotions are high as Spencer and Olivia eat lunch.

SPENCER

... I just can't believe you kept this from me. I thought we were done with all the secrets, Liv.

OLIVIA

(sips drink)

We are. But in this instance, I did what I thought was best... Alisha's testimony is a last resort. There was no need to get you riled up if she wasn't going to be called.

SPENCER

(frustrated)

You still should've told me she was back. I mean, what the hell?
