[Updated] EXO's Luhan reported to have filed to nullify his contract with SM Entertainment + Stock prices start falling

Rumors had been circulating among fans that EXO's Luhan's absence at the pastSMTOWN concert may not all be due to health reasons, and it seems the rumors may be right as reports have come out to reveal that Luhan has filed a suit against SM Entertainment to nullify his contract.

Many sources are indicating that Luhan has submitted his lawsuit at the Seoul Central Court this morning (10th KST). TVDaily also released a copy of the alleged application in which  the name 'Lu Han' can be seen.

The type of lawsuit he has filed, which is to determine that the contract is not valid and to nullify it, is the same one filed by former member Kris.

It's being reported that the same law firm that handled Kris's case is also taking on Luhan's.

SM Entertainment has responded to say that they're looking into confirming the situation.

[Update] - SM's stocks have taken a dip as it dropped 3,100 KRW within 15 minutes of this news being revealed. For a month after Kris's lawsuit was revealed, SM's stocks had hovered about 30% below their normal. Combined with Jessica's news, this Luhan issue has now set SM 19% below what its price had been at the beginning of last month.

We've also reached out to our contacts in the industry, who revealed that fan rumors are actually quite on track. The rumors had suggested that Luhan gave SME a specific date to sort this out for he had wanted to avoid a lawsuit. However, it seems the date that SM had to respond by had passed as Luhan has now filed to get out of the contract.

1. SM Entertainment is not able to give good future development plans for Luhan.

2. There is a discrimination in terms of treatment between Korean and Chinese members

3. The allocations of resources are not reasonable.

4. Experiencing health issues due to over-exhaustion in both body and in stress.

According to reports, SM Entertainment coordinates schedules for artists without consulting with them for their opinion, or considering their personal situations. Instead, the company notifies the artists after the schedules have been placed. When Luhan requested for a leave, the company would reject the request and respond that activities have already been set and that he must follow the schedule. 

Luhan also reportedly expressed concern that while the group has gained popularity throughout the years since their debut, there is no solid plan laid for their progress and growth. The artist is reported to have revealed, "It is a working environment where it feels like [we are] robots in a factory."

While Luhan has received requests for acting and advertising opportunities, none of them lead to successful negotiations. Between 2012 - 2013, EXO-K had over 5 endorsement projects, but EXO-M did not nearly have the same.

In terms of individual opportunities in Korea, there is an obvious discrimination towards the different nationalities. It is also highlightable that when EXO promotes on shows, the Korean members get a significantly longer screen time than their Chinese counterparts.

‘EXO 90:2014’ to Broadcast Lu Han’s Episode as Scheduled

With EXO’s Lu Han in the midst of a lawsuit against his agency, the show featuring the EXO member will air as scheduled. 

Mnet’s EXO 90:2014 featuring Lu Han, will be airing as it is.

EXO 90:2014 is a program that re-interprets the hit songs of the popular singers from the 1990’s through music videos and one EXO member is selected each week to be the main character in the music video.

Lu Han was the protagonist in the music video of EXO 90:2014 set to air on October 10 and the filming has already been completed.

Mnet revealed that the music video starring Lu Han will be unveiled through October 10’s broadcast ofEXO 90:2014 stating, “Since the content has already been filmed, it will be aired as was scheduled without any changes.”

According to Seoul Central District Court, Lu Han filed a lawsuit against SM Entertainment to terminate his exclusive contract. The content of the lawsuit is equivalent to that of Kris, who previously left the group.
