Constitutional Principles

Abortion violates many principles. Some of them are justice, general welfare, and legal rights. Justice is defined as "the fair application of laws, due process". If justice is that important, how is abortion fair to the child? General welfare is comprised of: well being of the people, basic needs met, health and prosperity, security, comfort, and happiness. Legal rights state that every person has: the right to retain life, liberty, property, and protection from cruel and unusual punishment. Abortion is certainly cruel and unusual punishment for an innocent child who has done nothing but exist. An abortion does not permit the child to have health, well being, comfort, and happiness, as an abortion is a highly painful procedure which ends in death for the baby who can do nothing to stop the doctor.

From the 5th Amendment comes "life, liberty, and the pursuit of happiness". When an abortion is performed, a child is denied all of these. Also from the 14th, 15th, and 19th Amendments we see "All [men] are created equal". Abortion treats the unborn as if their humanity is less than ours. Says Gianna Jessen, a pro-life abortion survivor who now has cerebral palsy due to the effects of the procedure, "If abortion is merely about women's rights, then where were mine?". This accurately sums up one of the most important points of abortion, the hypocrisy of claiming it is about women's rights while simultaneously denying another person their own rights.
