The Dark Arts, or Dark Magic, refers to any type of magic that is mainly used to cause harm to, exert control over, or kill the victim. The Dark Arts are not necessarily "evil" despite their namesake.
There are three unforgivable curses, Avada Kedavra, Imperius, and Cruciatus. All three are criminal and will have the practitioner in Azkaban. Only one of the three is considered truly evil; the cruciatus curse. There is no justifiable reason to use this curse because you must truly wish torture upon the victim.
