One of the reasons the refusal of the State of Utah and the Department of Justice to prosecute this matter is so unbelievable, is due to it being one of the simplest cases found in the record books to understand. In fact, this complaint can be decided without any need for a hearing or a jury trial since the following signature page from my parents' trust documents dated October 28th, 2015, leaves the defendants speechless and yet says it all:
Section 8.13 will haunt Kirton McConkie like a black plague on an infected rat waiting to strike them dead. If you tell an elderly couple dying of lung cancer and suffering from early dementia that you represent them as their attorneys, you sure as hell better not be secretly representing their greedy daughter and her husband instead. Under the laws of Fiduciary Duty, an attorney cannot legally represent both the Settlors and my sister as a Beneficiary. Yet, this is exactly what they have been doing since May of 2013.
I would ask the judges of the Third District Court of Salt Lake County and The United States District Court of Utah to ask a five-year-old of their choosing whether they want cookies or milk, but they cannot choose both or they go to time out.
Craig McCullough and Kirton McConkie can either represent Lisa Stephens or Max Eliason, but not both. Is this too hard for the 30+ judges who have heard this case to understand? Sadly, they do understand, but refuse to act thereby creating my need to publish this story hoping to force their hand into upholding the Constitution.
Craig McCullough not only drank the milk and ate the cookies, but decided to kill the teacher and do everything possible to hide the evidence against him and Kirton McConkie in the closet. The actions this prestigious law firm has taken against me and my family since their admission of guilt in February of 2019, are arguably the most heinous imaginable, and yet Craig is still sitting in his "elite" office while drinking my parents' milk and eating my sister's cookies.
I shall never forgive the thugs wearing black robes who dare call themselves judges for their refusal to intervene and stop the defendants from continuing in this mockery of justice. The actions of the LDS Church and Kirton McConkie are so pornographically criminal, that most people would not believe that any human being could be so wicked, especially when one of them has been anointed as the next "prophet to be" who as will be shown, is among the worst offenders.
"The truth is still the truth even if nobody believes it. A lie is still a lie even if everyone believes it."
As stated, Tom Mecham informed my father on February 11th of 2019, that Kirton McConkie did not represent my mother and father, and that he would need to sue them to protect his estate. Mr. Mecham left the law firm, and Kirton McConkie has tried to deny he ever made such a statement.
Regardless of whether this statement was ever made, the fact is they do have an undisclosed conflict of interest, and management has never tried to refute this truth, nor can they answer for the following email which was sent immediately following this meeting which has been spoken of.
I received this email from Mr. Mecham on February 23rd, 2019 (my mother's birthday), immediately following our meeting. The evidence is conclusive herein. Kirton McConkie told my parents they represented them and their estate as clients and settlors, and yet they are admitting to representing Lisa Stephens personally and as a beneficiary.

In summary, the trust documents prepared by Craig McCullough state that Kirton McConkie represents my parents. Yet here, Sr Partner Tom Mecham, while representing the Board of Directors of McConkie, admits they represent my sister instead. I have filed over 30 complaints in various courts over the past five years, and not one attorney or judge can explain away the answer to the simple yes/no question, which I feel is the most Poetic Justice ever heard of:
Do You Serve "ME "? (Max Eliason)
If Kirton McConkie answers "yes:"
They are guilty because they openly represent Lisa Stephens as a Beneficiary, not Max and Joyce Eliason as Settlors which is clearly unlawful.
If Kirton McConkie answers "no:"
They are guilty because the documents say they do; and if they did not prepare the documents then who the hell did?
Imagine the largest lawsuit in history coming down to a summary judgment because the defendants cannot answer one simple yes or no question. They should have studied the following scripture a little more, which proves Christ knew the issues surrounding conflict of interest and breach of fiduciary duty. You would think the leaders of the LDS Church and Dallin H Oaks would have been more familiar with this scripture.
