To make this crime successful, the criminals needed to convince my parents that their new attorney was legitimate and could be trusted with their wealthy estate. When my parents required the services of an estate planning attorney, Bryan and Lisa Stephens volunteered to locate one which led to the engagement of Kirton McConkie and Craig McCullough. Just the name of Kirton McConkie helped reassure my parents that their estate was in the best hands possible.
My parents did not trust Bryan Stephens; he and my sister knew it. For if they did, would they not have engaged him to prepare their estate plan since he is a specialist in the field? For them to pull off this coup, they needed to find a corrupt attorney who would lie to my parents' faces, and they found this man in Craig McCullough. Not only did my parents put their trust in this attorney and law firm, but they also put their trust in the LDS Church to stand behind the work of their attorneys. Below is the introductory email Bryan sent to me and my parents, and keep in mind that Craig was already representing both of my siblings, and their spouses, so this introduction was nothing more than a well thought out acting performance.
My parents executed every document signed between May 2013 and May 2018, believing that Larry Stillman (my mother's beloved brother) had not only recommended them, but had read and approved them. It would not be until six years later, in February of 2019, that I went to my uncle and inquired why his supposed attorney was refusing to return my calls or contact me after my mother's death, and his response was a shocking: "I've never heard of Craig McCullough or his father."
After realizing the lies that had been told to my parents, I sent a very angry email to Craig, demanding he state his exact relationship with my uncle since my parents had believed he was their attorney. Below is the paragraph taken from the letter of response which Mr. McCullough sent back to me on March 7th, 2019, wherein he responds as follows:
"In answer to your question regarding my initial representation, I understand that Ken Birrell of Kirton McConkie referred Max and Joyce Eliason to me. I understand that Larry Stillman was my brother's client, though I have not worked with Mr. Stillman."
When Mr. McCullough said these words, I knew for a fact that fraud had been used within my parents' estate plan, but never would have guessed the lengths to which the defendants had gone to in order to accomplish their crimes, nor did my parents have a clue as to how much their estate was worth. This type of lie and deceit is called "fraudulent misrepresentation," and it is considered a criminal action wherein an elderly couple was deceived and lied to hoping to gain my parents' confidence in their attorney and Kirton McConkie. By law, this fraudulent act alone should render the entire estate plan prepared by McCullough null and void, and McCullough should face criminal prosecution for his role in perpetrating this fraud.
Once again, if this is all the evidence I had, it is enough to send the criminals to prison for up to 20 years for breaching their Fiduciary Duty to my parents in such a criminal way. For what crime is worse than a group of professionals with the highest standards of professional ethics expected, get together in an obvious act of conspiracy to abuse and exploit the victims who trusted them? This deceitful lie was the first known criminal action which planted the seeds for the next decade of theft and corruption, but as shown herein, was just the beginning.
BRYAN STEPHENS AND CRAIG MCCULLOUGH, THE MASTERMINDS BEHIND THE CRIMESNo words in the English language are harsh enough for me to describe what I feel about these two felons at large. They have robbed me and my family of over a decade of precious life, while raping and pillaging my parents' lives work while depriving them of their last wishes. Their actions are beyond criminal for unprecedented assaults on the vulnerable adults they were both paid to protect.
Apparently, they were unsatisfied with the legacies found within their own families, and decided it was a great idea to steal that of my parents and ancestors and turn it into their own. Instead, the legacies they leave to their posterity are one of highest levels of shame, which shall be remembered forever due to the power of the internet.
These men, along with my sister, are the core criminals who commenced this most disgusting display of deep-rooted corruption which has now been ongoing for over a decade and counting. It is because of these three individuals that hundreds of lawyers and judges are now doing everything possible to conceal their crimes at all costs, which now includes the dismissal of my family's constitutional rights.
While I am far from grateful this tragic story had never happened to our family, this case has opened the door for the public to see what kind of people are leading not only a Church, but also the entire government of the United States. It is my hope that my words will help other victims realize what is happening to them, before they have crossed a point of no return.
