Chapter 15: What Becomes of The Broken Hearted

"Toby stop," I tell him as I flop down on my bed.

"The doctor gave me -"

"Explicit orders to make sure you stay in bed," I mock him. Saying it in my best Toby impersonation.

"Stop being a brat," He says to me with a laugh as he sits beside me. "I can pack up your stuff well, you instructions," He offers.

"Yeah okay," I tell him with a nod well I sit back against my pillows. He opens my closet pulling down some bags to begin to put some left over clothes here. Toby begins putting things in the bag well I shift between scrolling through my phone or browsing on my computer.

"Hey Spence, Toby," My mom says as she walks in. Sitting down beside me on the bed. "I talked to some lawyers about putting the house on the market, that's why I talked to Toby about you staying with him."

"So you're selling the house?" I ask Toby in the corner who seems to be trying to ignore the conversation the best he can so he continues to go through my closet.

"Yea, I'm taking your father to court over the divorce. He isn't reporting the best," She continues. This catches Toby's attention as he puts down one of his shirts that he left here on the red chair in the corner of my room and sitting on the arm of the chair. " I need you to testify."

"Testify what?" I ask her.

"He is refusing a settlement, he wants to take the whole worth of the house," My mom explains.

"I don't- I can't go to court. Not if he is there," I tell her. "If I don't testify will you lose everything?" I ask her.

"No Spence, it's I'd get a lot more money but this won't make or break me. But I don't want to let him get away without any prosecution,' She continues.

"So you want the win?" I ask her, anger beginning to push its way in.

"Spence I don't think it's like that," Toby says attempting to decipher the situation.

"I'm happy that he is gone. I don't want to see him again. If I don't go to the court with you, will I have to see him ever again?" I ask her honestly.

"No, you won't hunny. If you don't want to see him that's fine-"

"Is this about Melissa?" I ask her. The lack of my sister's presence is odd, and my night in the E.R. without hearing a peep from her left me to reflect on where my dad really ran off to.

"Melissa is on your dad's side," She says.

"I'm sorry," I blurt out quickly. I hear Toby let out a sigh but don't look over to him. My gaze stays on my mother who drops slightly in my apology.

"Don't apologize hun. If you're uncomfortable with it I'm not going to force you into it. I really don't want you to do something that you don't want to don't worry about it," She tells me as she begins to get up from the bed. She gives me a quick squeeze before moving to the door. "I'm just going to go pack some things up, I'll be downstairs if you need me," She says as she leaves the room. Bidding Toby and I goodbye; I can tell that she is upset with my decision to not want to see my father. But with the baby, -A and Toby the last thing on my mind is partaking in a court hearing too.

"Don't put this pressure on yourself Spence," Toby announces breaking the silence. He gets up from the chair and moves to sit beside me. I quickly move into his awaiting arms, wrapping my arms around his stomach and snuggling into his side.

"I'm sorry,' I say.

"Ha, for what?" He questions with a genuine laugh.

"Don't laugh at me," I say to him, hitting his stomach lightly. " I feel like I'm just annoying, that I constantly disappoint you," I tell him honestly.

"Wow Spencer telling the truth without being forced to," He jokes. I nudge him with my elbow causing him to laugh. "I'm kidding. You are never disappointed at all Spencer, you are the only easy and good thing in my life," He tells me. He squeezes me to his side and I move to snuggle deeper into his side.

"I love you," I tell him, looking up at him , puckering my lips in his direction. He laughs lightly and bends to give me a kiss.
