Callen's POV
Court day. I'm kind of looking forward to this. We're going to prove everyone who ever doubted the big guy, wrong. I'm in charge of the voice recording podcast. It's on a USB, in my pocket.
Everyone shuffles into the room. I go over to talk to Sam. The judge is there as well.
"Mr. Hanna, I just want you to know, I don't believe you did this. I'm not allowed to have my own opinions, but I know you're not capable of such a horrible crime." Says the judge.
"I've always wondered: do you know what evidence will be shown before the trial?" I ask.
"Yes. I'm aware of what someone has done to frame Sam here, and do I believe it? Hells no."
"Thank you, judge." Sam says.
"Please, call me Fred." I walk off to sit down.
--------
It's time. The prosecuting attorney has made some pretty bad accusations, but none that we haven't heard before. It's time for me to share the podcast. It'll blow this whole thing open. I reach into my pocket.
My hand searches the space but finds nothing but the denim material.
It's gone.
The only thing that can save my best friend is gone.
Someone probably pick-pocketed me. But that's not important. What's important is that I have to save him.
"Would the defending side like to present their case?" The judge says.
I get up and walk to the stand and take the oath. I sigh, panicking inside. I see Sam out of the corner of my eye, smiling, thinking I'll save him from life in prison.
"Please stand. Raise your right hand. Do you promise that the testimony you shall give in the case before this court shall be the truth, the whole truth, and nothing but the truth, so help you God?"
"I do." I sigh. "I-I-" I start to stutter.
"Do you, Mr. Callen, evidence that Sam Hanna is not guilty?"
"Y-yes." I sigh again. I know what I have to do. "You've got the wrong guy. How do I know that? I-it was me. I did it." Everyone gasps. Including myself. I didn't know if I'd be able to do it. Sam struggles.
"No! He didn't do it! He's lying!"
"Yeah! Callen didn't do it!" Kensi yells.
"What about the voice recording, Callen? Show them the podcast." Deeks says.
"G! Show them the podcast!" Sam yells.
"Order!" The judge yells. I pick up where I left off.
"I don't know what came over me. I was just so angry. I killed her. T-then I framed Sam so I wouldn't get in trouble. I pulled out all the stops. The dental marks, the saliva, the finger prints. I got it from the apple he was eating last week. I'm so sorry, man." I'm cuffed and they push me off the the side.
"No!" Nell runs up to the stand. "Eric Beale and I found a substance on the foot of the victim, it was sweat belonging to John Palinski. When we turned around, we as uh: Martin Deeks, Henriette Lange, G Callen, and of course Eric and I, Palinski was there and had us at gunpoint. He told is everything. How he framed Sam for the murder. We got it all on a voice recording podcast. He then said he'd have to kill us all. Before he could take the shot, Kensi Blye shot him. Callen didn't kill Montgomery, nor did Sam. There are witnesses. I honestly have no idea why Callen's confessing to something he didn't do. I swear it's the truth!"
"Then where is the podcast?" The prosecuting attorney says.
"I killed her, not Sam. Not any John Palinski, not anyone but me. Arrest me instead. Just let Sam go. He's innocent."
"That's not true!" Deeks says running up to the stand. "That's not true, I was there. I saw what happened, I even recorded the damn podcast! Callen, why are you lying? Where's the podcast?"
"There is no podcast." I know that without the podcast, no matter if there are a thousand witnesses, the jury will convict Sam. I have to do this, for him. He has a wife and a daughter.
What family do I have?
Well the answer to that: the people standing in front of me, trying to protect me from myself. But that's different. I was the one who's responsible for losing the podcast, but I won't be responsible for sending my best friend to jail, for life. I hate that this has to happen, but it has to happen.
"I was there too! I shot Palinski! He's covering for some reason! You can't convict him!" Kensi says.
"And I was there. Mr. Callen, what on earth is going on?"
"I was there too. Callen, where is the podcast? We both know there is one, that you had it, so where is it?!" Eric says.
Whispers turned to talking, talking turned to shouting. Soon everyone was yelling over the top of each other.
"Order! Order in the court!" Everyone settles down. "Mr. Callen, what is your final statement?"
"I'm guilty."
--------
The jury's results are back. I'm so nervous. No way in hell do I want to go to prison! But I always told Sam that I'd take a bullet for him, and I'm not just all talk. I'm just praying for some sort of miracle, but I'm not getting my hopes up.
"The results from the jury is back. After an anonymous vote, the jury has found the defendant, Mr. Sam Hanna, not guilty." I'm filled with relief. My muscles relax, I release my breath, and maybe even smile slightly.
"Although, the jury has also reached a decision on Mr. G Callen. The jury has found the other defendant, guilty."
---------
Ooooooohhhhhh!!!
How do you reckon Callen'll get out?! Will he get out?! Whatcha think?! Wow.
I'd like to dedicate this chapter to @ncis_ncis_la for giving me the idea to do this.
