That night we all snuggled into bed. Each of us held one of our kids. Were all scared. This could be the last night were like this. Were a family. We stay up late just holding them. Kissing them, singing to them. Reading to them. At eight we get up and feed Sig breakfast. Yes we give him pudding with banana in it but so what. We have to be at the court house at ten so were leave at nine. Handing over Montana to my mom is the hardest thing I think I have ever done. She will forever be my little girl. We get ready to leave and Beth runs to the bathroom. She empties her breakfast into the toilet. I get her a warm wash cloth and a drink. She quickly brushes her teeth and we leave.

When we get there were greeted by the Johnson's lawyer offering to settle for a month each summer at there home. Our attorney tells us not to take it. Beth does not. Really its her decision. We make it as a throuple but legally speaking she has the rights. For now.

A nine fifty five were ushered in and we sit down. The judge comes in and it begin. Shit gets real. I swear i'm going to be grabbing for the trash can any moment.

"Ladies and Gentlemen, this case was perplexing to me a little bit and I had to do some research. Most states would return the child known as Phillip Sig Johnson to his biological grandparents. Hawaii does not have a law in regards to this specific thing. My first thought was, yes he should be with them but then I went over the evidence. See Hawaii is legally in a weird place right now. The law regarding grandparents right was deemed unconstitutional but the law is in a gray area. So I then had to ask myself if taking the child away from a loving mom and two doting dads and placing him with a nanny away from his siblings is whats best for him?"

" Is taking the infants known as Montana Raine Kaoona-Lowel and Calvin Cade Kaoona-lowel away from there brother whats best for them? In my thirty plus years on the bench I have never seen anything good come of separating siblings. So for me its a package deal. Either they all go with the grand parents or they all stay with there mother. What keeps haunting me is what Ms. Elizabeth Johnson said. She told me that she feels like she has to prove that she is innocent? I look at the petition and the only thing that is stated there as a reason to remove the children is because Elizabeth Johnson, Ano Kaoona, and Devereaux Lowel cohabitation. So I looked over the laws. There is nothing in the laws against it. Then I made contact a few different psychologists that deal with this kind of thing and ask them about children that grow up in a poly home."

" I'm surprised to hear that there no different then any other child. I am told that children from poly homes tend to grow up more understanding and accepting. So after seven hours of testimony yesterday and me reading every letter in the binders and the research I did. Well I have not been to bed. I wanted to get this right. Three innocent lives are at stake here. So after all that I come back to Ms. Johnson's comment about her being on trial simply for being in love. That she has to prove her innocence vs the other side proving there case. Well there case was simple. Three consenting adults admitted to being in a relationship. So yes the plaintiffs proved there case" 

The Johnson's got up and started yelling and the three of us just lost it. We had to hand over our kids. Then he continued. "i'm not done. What they proved and what is a crime are two different things. Its not against the law to be in a relationship with more then one person. They are not committing a crime. Nor are the children at risk, its just the opposite. The children in question here are thriving. There happy. There safe. There loved. There healthy. Every need has been met, every milestone met. There loved beyond words.  So my decision is to award custody to Ms. Elizabeth Johnson. Congrats mam. Is there anything else?"

"yes your honor the defendants would like to ask for order of protections for all six of them. They feel that the plaintiffs may try something else. They have ignored the court order set fourth by the judge in Kodiak Alaska." Dan asks.
