CROSS-EXAMINATION: AYA EVE-FOX - WHAT I SAW AT THE DUCK POND

-I was at the duck pond looking around when I saw something...

-I saw a man pushing something on a man's ankle as he handcuffed him and pushed him to the ground...

-I saw a body in the duck pond, so I ran away out of fear...

-I-I overheard a woman saying that she was happy he was dead...

"OBJECTION!"

I looked up to see Mr. Devine tapping his forehead gently. "You just said that a woman said that she was happy he was dead. However, this contradicts the fact that the defendant is a young man," he declared. "I believe that this is rather conclusive evidence that the victim is not the killer!"

The judge slammed his gavel on the bench. Everybody in the courtroom had begun to chatter as they always did. This was the only way to get everybody to relax, I knew. "Everybody quiet!" he declared before turning to face the defense. "Are you sure that this must be the case?!"

Mr. Devine nodded. "I'm positive. The witness from yesterday was a male and our defendant is also male. Some might argue that this witness could have killed the victim, but I don't think that's the case. After all, the witness is a very small and fragile girl. There's no way that she could attack somebody so much larger than her such as the victim," he told the court. "As if things couldn't get any better, then I think that I have an idea as to who really did kill the victim!"

"T-then why don't y-you call h-her up to the s-stand?" Prosecutor Burke asked. I had to really strain my ears to hear him, as the people in the gallery were still chatting madly and he spoke rather softly.

Mr. Devine nodded. "Alright. The defense calls D.K. Killa from the gallery down to the witness stand!" he exclaimed.

I pulled Aya away from the witness stand. She looked up at me with her wide brown eyes. "Do you think I did alright?" she asked of me.

I nodded. "You did just perfectly," I told her. "You really helped out the defense team."

Aya smiled and nuzzled my arm as we took our seats at the witness bench to the side of the prosecutor's bench. We watched together as a woman took her place at the witness stand.

"State your name and occupation please, witness," the judge declared.

The witness took a bite out of an apple that sat in one hand. "D. K. Killa. I'm currently unemployed," she declared. She puffed on her cigarette, which sat in her other hand.

Mr. Devine swatted at the air around his face. "Please testify about what you saw the day of the crime," he said as he plugged his nose. Ms. Starr coughed from beside him. Neither one of them was agreeing with the smoke at all.

Ms. Killa nodded. "Alright," she declared.

WITNESS TESTIMONY: D.K. KILLA – THE DUCK BOY DID IT

-I was down at the duck pond walking around when I saw it.

-I saw the defendant over there killing the victim!

-I left the crime scene immediately after since I didn't want to witness such a gruesome scene.

-I was too shaken up to call the police, I'm afraid.

-I knew that his name was Zhu Keep since I saw his identification tag as he was being killed.

Mr. Devine smirked. "The defense will now begin its cross-examination," he declared. I could tell by his tone that he knew something was amiss in the witness' testimony. I was glad for that. I didn't like hanging around in courtrooms for longer than I needed to.

Prosecutor Burke nodded. "O-okay," he said quietly.

"OBJECTION!"

The witness stared up at the defense angrily. She didn't look all that happy that she had been interrupted. "Excuse me?" she asked. "What in the world was that rude interruption for? What did I ever do to you?"

"I'm just here to tell you that you are trying to lie to this court, which is a serious crime, witness," smirked Mr. Devine. "I know for sure that you've been lying, and I'm sure that everybody in this court will know it as soon as I explain my thinking behind the situation."

"Then go on and explain! I won't take well to being called a liar, you know!" Ms. Killa yelled angrily. She puffed on her cigarette once again. I made sure that Aya was holding her nose before plugging my own. I hated inhaling smoke like the witness was making us do.

"There was no identification found on the victim's body. That was one of the main reasons behind this case being so mysterious. Nobody had even the slightest idea who the victim could be. There was no source of identification found anywhere on his body and since it was impossible to determine fingerprints, nobody had a clue," Mr. Devine explained.

Ms. Killa glared at him. She knew what was coming. I was starting to get a pretty good guess as to what it was as well.

"You couldn't have possibly seen the victim's name on a tag or anything of the sort since there was nothing found on the body! You're trying to cover up for knowing the victim's name, and I think I know why!" Mr. Devine pointed at her powerfully. "You're trying to cover up for the fact that you killed the victim so that you don't end up going to jail!"
