MEMORANDUM OF AGREEMENT
This Memorandum of Agreement (hereinafter referred to as “Agreement”) is entered into on this August 21, 2019 by and between:
LEA CARMEN SALONGA-MUHLACH, of legal age, Filipino, residing at 32 Solis Avenue, Alabang, Muntinlupa City (hereinafter referred to as the “First Parent”),
ARIEL AQUINO MUHLACH, of legal age, Filipino, residing at 32 Solis Avenue, Alabang, Muntinlupa City (hereinafter referred to as the “Second Parent”),
And
MARGARETTE HAEL SALONGA MUHLACH, of minority, Filipino, currently residing at Unit 703, Tower B, Summit Residences, Alabang-Zapote Road, Muntinlupa City (hereinafter referred to as the “Child”).
WITNESSETH:
WHEREAS, the First Parent and the Second Parent (hereinafter referred to as the “Parents”) are the legal and biological parents of the Child,
WHEREAS, the Child, currently 17 years old, is expected to reach the age of majority (18 years) on May 12, 2020,
WHEREAS, the Parents have expressed a desire to have the Child reside with them for a period of ten (10) months, beginning from the date of the signing of this Agreement,
WHEREAS, the Parents are concerned about the Child’s well-being and desire to ensure that they spend adequate time together before the Child attains legal adulthood,
WHEREAS, the Child is willing to comply with the Parents’ request for the specified period under the conditions stated herein,
NOW, THEREFORE, for and in consideration of the mutual covenants, promises, and conditions set forth herein, the parties agree as follows:
A. The Child agrees to reside with the Parents for a minimum period of ten (10) months, commencing on _____________ and ending on ______________.
B. The Child agrees to live with the Parents and to comply with the reasonable household rules, as set by the Parents, during the ten-month period. The Child also agrees to engage in regular communication and follow the family’s expectations regarding mutual respect and cooperation.
C. The Parents agree to:
1. Ensure the Child’s safety, well-being, and emotional support during the ten-month period.
2. Acknowledge the Child’s growing independence and respect their personal space, while providing guidance as necessary.
3. Foster an environment of open dialogue, allowing the Child to express concerns, ask questions, and share thoughts freely.
4. Encourage the Child’s academic, social, and personal growth by providing necessary resources, guidance, and emotional support.
5. Not impose unreasonable or overly strict rules that hinder the Child’s development and autonomy during the ten-month stay.
6. Provide for the Child’s basic needs, including but not limited to shelter, food, clothing, and educational support.
