Chapter 28: The trial

As the trial on the merits of the case against Bernadette proceeded, the courtroom was filled with a tense atmosphere. The prosecution began presenting their witnesses, each one taking the stand to provide testimony related to the charges.

When Maxim Cuevas was called as a witness, a murmur ran through the courtroom. Maxim, dressed formally, took the stand and was sworn in. His demeanor was serious, and he cast a brief, intense glance at Bernadette before focusing on the proceedings.

The prosecutor began questioning Maxim. "Mr. Cuevas, can you please describe your relationship with the accused, Bernadette Lacuesta Cuevas?"

Maxim cleared his throat before responding. "Bernadette Lacuesta and I were married. Our relationship was, at times, strained, but we were committed to making it work."

Prosecutor: "Mr. Cuevas, you mentioned that your relationship with Bernadette was strained at times. Can you clarify if there were any specific incidents or issues that contributed to this strain?"

Maxim:"Yes, there were disagreements and conflicts between us, particularly regarding our personal lives and certain decisions. However, we were working on resolving these issues."

Prosecutor: "I see. Given these strains, would you say that there was a significant amount of tension between you and Bernadette prior to the incident in question?"

Maxim:"There was tension, but we were also trying to address and manage it. It wasn't always as severe as it might appear."

Prosecutor:"You've described Bernadette as someone who was committed to the relationship. Despite the tensions, did she ever display behavior that could be seen as violent or threatening towards you or others?"

Maxim:"No, Bernadette never showed any violent or threatening behavior. She was upset at times, but she always handled conflicts in a manner consistent with her character."

Prosecutor: "Can you tell us if there was any reason to believe Bernadette would resort to violence, especially in the incident involving the killing of Clarissa?"

Maxim: "Honestly, no. Based on my experience with her, I don't think she would resort to violence. I was shocked to know she shoot us."

Prosecutor: "So, if you are saying that Bernadette had no history of violence or threats, why does she able to shoot tou and Clarissa?"

Maxim:"Because of what she saw... I and Clarissa was in actual act of carnal act."

Prosecutor: "No more question your honor,"

Judge: Cross.

Defense Attorney, Atty. Santos:"Mr. Cuevas, you've mentioned that Bernadette's actions were influenced by what she saw on that night. Can you clarify exactly what you mean by that?"

Maxim:"Yes, she witnessed Clarissa and me engaged in a personal act. This was what provoked her reaction."

Defense Attorney:"So, you're suggesting that Bernadette's actions were a direct result of seeing you and Clarissa together having carnal act in that moment?"

Maxim: "Yes, that's correct."

Defense Attorney:"Is it possible that this was an emotionally charged moment for Bernadette, one that might have led her to act impulsively rather than as a result of a premeditated intent to cause harm?"

Maxim:"I suppose that's a possibility, given the emotional state she was in."

Defense Attorney: "Given this emotional context, would you agree that Bernadette's reaction might have been more about the shock and betrayal rather than a deliberate act of violence?"
