13: A Moral Failing

Once again the meeting room was filled with silence. 

They were joined by detective Tsukauchi and Nezu this time but otherwise the heroes assembled were the same as the last time. All Might wanted to ensure his voice was heard throughout the whole meeting as he had been there. 

Midoriya and Uraraka had given Tsukauchi statements but weren't allowed to be in the room. They needed to decide what charges to press against the boy. They wanted Kyo himself to be there, to weight in on his own fate and tell them what he thought of himself but he was still comatose. 

He had been taken from U.A by ambulance that night and was now off life support but still so deeply asleep from quirk overuse they didn't know if he would wake up in days or months. His quirk parameters were still unknown. 

"So, to review the facts, Kyo became enraged at the sight of his dead comrade-" "Friend." All Might interrupted, Nighteye ignored him. "And strangled the former no.1 after kicking a student in the jaw. Then, somehow, his quirk evolved to allow him to use a kiss on All Might's forehead to not only bring him back but also the villain Toga Himiko, who had been dead for roughly 10 minutes already.". Sir Nighteye cradled him head in his hand, leaving his now amputated one at his side. 

Aizawa had a hard time believing what he was hearing. He didn't know what to make of the situation and what the step forward they would decide on would be. "Accounts from Midoriya Izuku, who was present at the scene, record All Might apologizing to Kyo, who was sobbing about not having been saved before All Might dying and dropping to the ground. Then the quirk evolution event occurred and Kyo said, and I quote "I accept the apology" and "I'm sorry too."." Nighteye said those statements as if they were ludicrous.

They definitely didn't sound like things a villain would say while murdering the no.1 hero but they all believed Midoriya's testimony. "I," All Might said, breaking the silence "Do not wish to press any charges, if that is what you are pushing for." he glared at his former sidekick. "I do not believe he was mentally sound at the time, which isn't very hard to believe with his trauma, compounded with believing we killed his friend.". 

"So you want the villain who murdered you free?" Rocklock said, outraged. "You misunderstand." All Might said simply "I was dead for barely a few seconds and now I'm only a little worse for wear than I was before my first battle with All For One. He has done far more for good than for evil. My organs are all back to where they were before the injury.".

"Not all of its been good." Ryukyu said "He's still been identified as a murderer of one man, Watanabe Fudo. Midoriya testified that he admitted to multiple murders but we have found that to be untrue.". Tsukauchi nodded. 

"So far he has murdered one man and stabbed a student, almost fatally. Not to mention getting in a fight with both the student he stabbed and two other student." Fat Gum said matter-of-factly. The pro heroes all nodded, none of it was untrue. 

Yet, they still couldn't decide. They didn't even know what the options should be. Surely whoever killed the no.1 hero should be in Tartarus right now but All Might insisted he was fine and they all felt the need to respect his wishes. 

"I would like to bring up the information that all evidence we have on the murder compounded with our information about Kyo the murder charge makes a lot of sense." Aizawa said, shocking everyone "I was the one handling the brothel raid and all ringleaders testified that Watanabe was one of the main abusers of all people there, including Kyo. He was also the main purchaser of quirk trafficking victims.".

All Might looked to Aizawa with a grateful smile. "I propose a vote." All Might said "Option one, we send him to prison on the assault and murder charge." several heroes nodded "Option two, rehabilitation. We put the focus on making him mentally sound again. I must remind you that we are not dealing with someone like Shigaraki Tomura, we are dealing with a 15 year old child with as much if not more trauma than some of us pros. It is in no way an excuse for his violent actions, but it is an explanation.". 

Silence blanketed the room. They decided to let it sit for a while and resume in a week to decide Kyo's fate whether he had awoken by then or not.

Three days later and All Might, Uraraka and Midoriya had decided to visit Kyo in the hospital. He still hadn't awoken but they all felt the need to see him in person. To look at his sleeping form and decide what they thought of him.

The nurses gave them an hour to sort themselves out before they would have to leave the patient in peace since they weren't family. Midoriya opened the door slowly and the trio filed in. 

Kyo was lying face up on the bed with an I.V in his arm. He didn't need an oxygen mask or anything since he wasn't technically comatose, just asleep. None of them dared to speak or move more than a little shuffling. 

Suddenly, something caught Midoriya's eye. Several pieces of paper sat by the window. Curiously he reached out for one a read it, thinking it would be a medical record. But it was a get well card, from the league.

"Aren't they all in Tartarus?" He asked. All Might nodded. "They were made aware of Kyo's condition so they could make statements and sent their legally allowed last formal letter to the hospital." He explained. Midoriya was shocked that they would use it for this, but he was more curious to read what they said. 

Out of the main league members only Dabi had escaped and now he was god knows where. Shigaraki, Twice, Magne and Toga had all been captured and all sent letters. Midoriya unfolded the first one, it was from Twice and signed as such in two different handwritings. 

'Get Well Soon Kid! -Twice' was the only thing written. The rest of the page was covered in small drawings of things like hearts and stars. Midoriya didn't understand so he moved on to the next one, Magne. 'I'll miss you, don't wait up for us Kyo. Enjoy your life.'. The writing was spaced out, large and simple. Were the league that mentally unstable? 

'Love you baby! I'm glad you are alive and that I am too! Keep your blood safe! -Toga'. Still it didn't make sense, they were all covered in hearts and written in the same fashion. 'Kyo, we were all caught. I may not see you again but you should know I have faith in you, if you know what that means. This is not the end. Keep studying. -Shigaraki Tomura'. That one had only one small heart that looked like it was done messily at the last minute. 

"Its like they're writing to a child!" Midoriya said, his confusion boiling over "Do they not have anything more to say? They're all so short and simple.". 

"You don't know?" All Might said, genuinely surprised. Midoriya looked at him and said nothing, so he continued. "Kyo couldn't read. He probably learned a little since they wrote to him but when he spent that day at U.A he couldn't read a single word, even his own name. They probably drew the pictures incase he couldn't understand their words.". 

That was a lot to unpack. 

"I saw him strangling you." Midoriya said, his eyes cast down "I saw that and yet-" his breath hitched "I want you to push for rehabilitation.". 

The other two couldn't agree more.

Kyo's fate is up in the air and pro heroes are not merciful!
