"Okay class, papunta na tayo sa exciting part." Paunang bati ng aming guro pagkapasok niya sa room.
"Our final examination will be next week." Our instructor announced. "Ready na ba ang lahat para sa exam?" He added.
Everyone groaned. "Hindi pa po," one said and everyone seconded.
"Next week na agad sir?!" Gulantang namang tanong ng isa.
"Yes, next week agad. It's been a month since we took our semis." He recalled. "May mga katanungan pa ba? Violent reactions? Wala? Okay, we will have a short discussion. Recall lang sa ating previous topics to freshen you all up."
Sinuot niya ang kaniyang reading glass at nagsimulang magbasa-basa sa kaniyang libro. Ginaya na rin namin siya upang kahit papaano ay may maisagot sa kaniyang mga katanungan.
"Okay!" Lahat kami ay nagulat nang bigla niyang sinarado ang kaniyang libro at tumayo. Naglakad-lakad siya sa gitna na parang rumarampa.
"Is it possible to arrest someone without a warrant?" He asked. There is a long deafening silence in the four corners of the room. "Anyone?" Wala pa ring sumagot.
Jisnel raised his hand. "Yes Mr. Facuña,"
"Yes, Sir. It is possible to arrest someone without issuing warrant of arrest. This act is called warrantless arrest under Article 113 Section 5 paragraphs A, B, and C of the Revised Penal Code." Akmang uupo na sana ito nang nagsalita ulit ang guro.
"In what way? And can you briefly discuss warrantless arrest is?"
Tumango si Jisnel at nagsimula na "When you are a uniformed personnel and you have witnessed an incident, for example a murder or homicide case. You can arrest the culprit right away without the warrant of arrest. This is called inflagrante delicto, or caught in the act."
"Okay, that's in paragraph A. Thank you Mr. Facuña, you may take your seat. How about when a civilian witnessed a crime? Can he or she arrest the culprit?"
This time I raised my hand. "Yes Ms. Park?
"He or she cannot arrest the culprit alone, Sir. But he can report the incident to the nearest police station, however the witness must come along with the authorities to state what he has seen in the crime scene and to identify the culprit. He's the primary witness and his personal knowledge about the scene can be the evidence."
"Okay, that's in paragraph B. Tama kayong dalawa ng sinabi. Nasa arrest naman na tayo, dagdagan natin ang katanungan." He paused a bit to give thrill.
"Kailangan pa bang i-state ang Miranda Doctrine or Miranda Rights kapag inaresto ka ng walang warrant of arrest?"
"Yes!" The crowd sang.
"Why?" Sundot na tanong niya.
"How about Mr. Alvarez?" Turo niya kay Liam. "Why must we state Miranda Doctrine or Miranda Rights when arresting someone?" Ulit niya sa tanong.
"When you failed to state the Miranda Doctrine while arresting or handcuffing the culprit, this can be used against you. Because the Miranda Doctrine composed of the rights of the arrested person such as the right to remain silent, right to have an attorney."
The review discussion went on. After class Jisnel and I went to the cafeteria to eat our lunch but we witness a commotion.
Pinapalibutan ng mga kapwa namin studyante ang isang table, wari ko'y may nagaganap na kung ano. May isang babaeng nakatalikod sa amin ang may hawak na isang basong walang laman. Sa harap niya'y isa ring babae na nakayuko't basang-basa ang kaniyang puting uniform. Nagmantsa sa kaniyang damit ang kung anong likidong isinaboy sa kaniya.
