Peter is like Varian in this situation. Trust me it will all make sense.

Summary:
Peter has never met the avengers, and is in no way connected to Shield or Tony Stark. He is wanted after the Mysterio incident, and Peter is trying to make them realise he is innocent. In this Mysterio not on revealed Peter's identity but framed him for stealing Stark tech, which is why the avengers are involved.

In this AU, no one helped with the elemental attacks, Shield did not get involved. It was only Spiderman and Mysterio. Also no one died in Endgame, Cap isn't old and Tony isn't Peter's mentor.

Peter swung through the streets of New York with MJ on his back. They had stopped for a moment to catch their breath when a news broadcast played on one of the massive screens in Times Square.

"Breaking News: The tragic murder of Mysterio was committed by none other than Spiderman. We have a short video shot by Mysterio himself before the murder.

"Mysterio: I managed to send the elemental back through the dimensional rift but I don't think I am going to make it of this bridge alive...Spiderman attacked me for some reason he has an army of weaponized drones... 'AI voice: Are you sure you want to commence the drone attack? There will be significant casualties' Spiderman: Do it. Execute them all. "

"The shocking video was released earlier today on the controversial news website The Daily Bugle."

"There you have it folks. Proof that Spiderman was responsible for the brutal murder of superhero Mysterio. An inter-dimensional warrior who gave his life to protect our planet. And who will no doubt go down in history as the greatest superhero of all time. But that's not all folks, here's the real blockbuster you might wanna sit down."

"Mysterio: Spiderman's real na-...Spiderman's real name is P...*static*  Spiderman's name is Peter Parker."

Since that broadcast Peter's life has not been the same. Framed for murder, stealing Stark tech and endangering the life of millions. He has been on the run for months, evading the avengers, Shield and criminal organisations wanting to recruit him.

Only three people know of his innocence. MJ, Ned and that piece of shit people call a superhero: Mysterio.

"Peter we need to prove you are innocent."

"How Ned? They have enough proof, even though it is all fake, to lock me up for life." Peter yells, throwing his already cracked phone across the motel room that MJ bought for him. The third room that week.

"I don't know Peter, but we have to try. You can't keep living like this. You are a kid, you shouldn't be out here alone." Ned sits himself next to a now crying Peter, patting his shoulder comfortingly.

"I just wish they would listen to me. If they would let me speak, let me explain then maybe, just maybe, they would see the truth." Peter cried into Ned's shoulder. A sharp knock at the door sent Peter into panic mode.

"Open up!" A low, menacing voice shouted, pounding on the door.

"Run Peter. Take your suit and run!" Ned whispered, shoving him into the bathroom.

Peter could hear Ned unlocking the door. He would have under a minute to get away from the building before he was caught. He pulled on his suit not caring he had clothes on under it and launched out of the tiny bathroom window.
