The next morning Kathleen walked into the office and sent a message to Liam and Ryan confirming the time for her meeting and the dismissal of Brian. In addition, she was having a member of their legal team meet with them who was bringing the termination documents, a copy of his NDA, copies of this employment fraud and company policies agreements signed for the past few years, and the legal suit that is being filed against him. The companies' attorneys reviewed everything yesterday afternoon and would have all the documents ready this morning. Katie reviewed Paula their staff attorney's law suit and documents last night and send a few revises she wanted.
Paula was already waiting in the conference room. "I made the adjustments you wanted. I was shocked you are taking it easy on him for the breach in policy and misappropriation of company funds."
Brian has been a good employee for 5 years without issue. I do not know what has gone on in the past few months, but and would have been willing to let it side on past performance it was just that. The lying and mistreatment of his staff is something I will not allow.
Liam and Ryan walked in escorting Brian whom she would bet let him think it was a coincidence bumping into him on the way up.
"Brian, have a seat" Katie guested to her right from where she sat at the head of the table. Ryan sat beside him and Liam talked around to sit next to the Attorney Paula. Both men showing physical support to the women in the room, but Brian did not notice. He sat without a care in the world. He like most underestimated her.
"Brian let me get right to it. You have been with us for just over five years now. You review over those past years have been stellar and your teams succuss outstanding." She stated and saw Brian sit up straighter in pride.
"That being said your overall behavior and personal and professional performance has suffered over the past few months." Brian's smile faced from his face. "A look at you and your team over the past few months shows several employee policies broken and disregard as well as a few laws broken. I have here a list along with two choices for you to review." She slid over a bullied two-page summary.
"Your team has been doing their work load and you're for two months now. You have used your corporate credit card for a never of expenses that are not company related and claims that to be so. From your dry cleaning, meals with clients, gifts for clients and your team which never happened. A deep review of your company activity in our database shows little to no actual work being done by you. You have been taking credit for your team's hard successful work. You have "missed" several days in the office and reported that you were meeting with clients. You will see that we have confirmed this to be a fabrication as the "clients" confirmed this as well as the GPS on your company phone." She when over each issue while sliding a detailed report to him with date, times, places, confirmations from a number of sources. "I can explain" Brian started, but was cut off by Paula.
"I have her the last few years of your employment agreement documents here that show a clear violation of the company's policy, trust and the a few legal laws. Here is copy of the suit I prepared after learning all this which including restoration and jail time. No Ms. Fitzgerald said two options. You can choose this one which shows you would need to pay restitution of $6,874.14 to the company plus again the jail time if the police are called." She pawed seeing his panic. "Or, you can pay restitution and compensation of $15,000 and we will not call the police. Either way Fitzgerald will hold you the NDA, confidentially agreement and the breach of that is $2 million. You will see that copy of that in your signed in front of you. We will also be issuing a gage order for you for any and all dealing surrounding the Fitzgerald, O'Brien's and any and all business information you may have knowledge of. You will also not be receiving any reference, but we agree to not comment of you or your dismissal. That is unless you break your DNA and confidentially agreement for the business and families. Ms. Fitzgerald is being generous if this second offer in my option." Brian paled even more. "You are more than welcome to think about this and get back to us. You have until 2pm Friday. If you have not contact me personally at the number listed in your termination packet here with one of the two options in this folder" Paula said pushing the document over to him. "I personally will call the police to have you arrested. Just to make things clear your employment is effective immediately terminated. Your just is being cleaned out of personal belongings and will be brough to the main lobby by security. You building and corporate credit card has been cancelled."
