Sitting at the bench with his client the next day before the Trial began officially, Lindsey was furious.

"You lied to me, there is a witness that says you were there." 

"It would've given her more ammunition and I didn't think anyone saw me." He states.

"Elliot, you can't lie to me like that." Lindsey grits in a low voice. 

"I didn't go there to kill him dammit, I went there to talk to him," Elliot growls also quietly.

The judge then enters, and hands over the first witness to Carol Ann Harris. "The state calls lieutenant Derick Scott to the stand. When Lieutenant Scott is sworn in, Carol presents a handgun. 

"Yes, I recognize that gun, It has my tag on it, it was found when I arrested the defendant it was in the glove department of his car."

"The bullet that killed the decedent came from this gun yes?" 

"Yes, ma'am." 

"Can you identify this?" 

"Yes, it' s a ball marker from the tournament that the defendant went to. It was found on the ground infront of the decedent's home on the night of the murder, about four feet from the back door." 

"Have you found any more in the course of this investigation?" 

"Yes, there were three in the defendant's possession when he was arrested." 

"Thank you."

"Mr. Buckingham?" 

"No questions." 

"Why didn't you ask him anything?" Elliot whispers to Lindsey.

"Because the more he talks the guiltier you get." Lindsey purses his lips. 

"Your honor may we approach?" Carol questions. 

He nods and Lindsey and Carol make their way up. "Your honor, I just learned that someone with information relevant to this case has come forward and is ready to testify." 

"Ugh, your honor..." 

"And I'm sorry to do this to Mr. Buckingham and he has every right to object but the witness is out in the hall right now, and I don't know how long he'll be available.

"But ugh, your honor."

"If you allow me to call him right now I would have no problem whatsoever if you were to call a recess until tomorrow morning thereby giving Mr. Buckingham more time to prepare his cross." 

"Counselor?" The judge questions. 

Lindsey takes a moment and looks back at the courtroom full of people, making eye contact with Stevie, who's giving him an indescribable look, and he knows better than to say no. He's finally getting back into her good graces. "I guess I can live with that." 

"State calls Mr. Frank Brighton to the stand." 

"That's the guy I was in jail with...I don't understand." Elliot looks to Lindsey. 

"My name is Frank Brighton, and right now I'm living at the downtown  hotel." 

"Mr. Brighton, I understand you know the defendant?" 

"Yes, he and I shared accommodations recently." 

"You were in a jail cell together."

"Yeah." 

"You met the defendant on the 24th, last week, the day after the murder is that right." 

"Yes, that's when we became cellmates."
