it had been a few days since spencer had been arrested, and the team had just gotten back from a case. well everyone except evelyn. emily's had given her some time off due to the situation so she had said back in quantico, while everyone else, including garcia, went on the case. she was getting for the court hearing where his bail was to be posted and she was nervous, yet excited. rossi had offered to pay the bail, no matter how high it was and she was forever grateful for that, because it meant spencer could come home soon. evelyn checked herself in the mirror one last time when she heard a car honk outside, meaning penelope was there to pick her up. she turned to the side, making sure her almost non existent bump wasn't visible. spencer still didn't know about her being pregnant and she didn't plan on telling him until the whole situation was dealt with so she didn't stress him out. she sighs softly, approving of her appearance as she walks out, getting into the car. "he'll be home soon." penelope says, trying to lighten the mood as she could tell evelyn was worried. "what if the bail is too high and we can't get him? or what if there's not bail at all? or what if-" she rambles, penelope cutting her off. "we'll get him. i promise." penelope says softly, evelyn sighing. the rest of the ride was quiet, evelyn continuing to look worried. once they arrived they went in, evelyn and spencer locking eyes as soon as he cane out. "soon." she whispered to him, spencer nodding softly as he sat down. oh how she wished she could just hug him and kiss him and play with his hair, telling him everything would be okay while they waited, but obviously, she couldn't. soon it started, evelyn practically holding her breath the entire time. "ms. duncan, your client is an fbi agent, correct?" the judge said, spencer's lawyer immediately standing up. "that's right, your honor." she says, the judge glaring at spencer making him immediately stand up. "you're charged with murder, which is a very serious matter." the judge says. "yes, your honor." spencer says, nodding. "all right, ms. duncan, does your client wish to enter a plea at this time?" the judge asks. "he does." fiona says. "and how do you plea, agent reid?" the judge says. "it's doctor." evelyn whispers, spencer slightly turning around as if to tell her to be quiet. "not guilty." spencer says, matter-of-factly. "thank god." evelyn whispers. spencer looks back at her, this time sympathetically. "and as to bail?" the judge says. a third man stands up, "the people oppose bail and request remand, your honor." he says. "your honor, my client presents no risk of flight." fiona says. "that's ridiculous, the defendant was arrested after fleeing the murder scene in mexico." the third man says as spencer sits down. "oh shut up." evelyn groans quietly, spencer shooting her a look. "those were extenuating circumstances." fiona says. "he's been drugged against his will." she continues. "by failing to notify the fbi of his international travel, the defendant violated the bureau protocol." the man says. "my client presents no flight risk, he has deep ties in this community." she says, spencer looking back at evelyn sympathetically as he knew this was hard for her. "i'm okay." she whispers to him, nodding. "his mother suffers from alzheimer's disease and schizophrenia, and lives with him. he is solely responsible for her well/being. additionally, he's been a decorated ssa with the FBI's behavioral analysis unit for over a decade." she continues. "and as an fbi agent, he has contacts all over the world." the man says. "agent reid would be willing to turn over both his personal and government issued passports." fiona says. "if he wanted a counterfeit passport, he could easily get one." the man argued. "he has no criminal history." she says. "the defendant is uniquely situated to evade law enforcement should he else fled the jurisdiction." the man argued. "your honor, he wants to stay here and clear his good name." fiona says. "he should have thought about his good name before sneaking across the border." the man said. evelyn was furious at what she was hearing. how could someone says these things about spencer? "i'm prepared to present multiple law enforcement character witnesses-" fiona starts, the man cutting her off. "one of which is his girlfriend, might i add, so that's already biased." he says, the statement immediately setting spencer off, fiona glaring at him to stay quiet. spencer looks back, whispering an "i'm sorry" to evelyn. evelyn nods back "it's okay." she whispers back, Spencer turning around. "regardless of the relationship to my client, i have them, and i'm ready to present them on his behalf." fiona continues, glaring at the man. "the witnesses are here in the courtroom, all highly respected fbi agents." she says, motioning to the bau team. "simmer down, ms. duncan." the judge says. "it's almost 6:00 and i'm not inclined to hear from character witnesses." she continues. "actions speak louder than words, i always say." she continues. "we'd be willing to abide by a curfew." fiona says. "and strict monitoring of his whereabouts at all times." she continues. "a little too late, counselor." the judge says, crossing her arms. "if last behavior is the best indicator of future conduct, and i do believe it is, then your client presents a flight risk." she continues. "oh no." evelyn whispers. "bail is denied. defendant will be remanded to federal custody pending trial." she says, banging her gavel, dismissing court. evelyn froze, not believing the words. "he's coming home right? i mean he has to, right? right?" evelyn frantically says, tears welling up in her eyes. "oh evelyn, no. at least, not right now." penelope says, evelyn breaking down in her arms, watching as spencer was handcuffed, spencer looking at evelyn the whole time. "i'm so sorry, evelyn." he says as he's walked out. this can't be happening.
