The only reason Draco wasn't in the black lake for the 2nd task is because Lucius would sue the absolute shit out of Hogwarts for that

Harry swam over to Hermione and tried to untangle the seaweed that was holding her in place. The merperson guarding the hostages pointed a trident at Harry and shook their head before pointing at Draco.
"She's my friend" Harry argued "He's... Well, things are complicated with him"
"You take him." The merperson responded
Harry swam over and started to untie the seaweed that was holding Draco, as he did Cedric swam by blasting Cho free and looking at Harry before pointing to his wrist, reminding Harry that the task was timed. Harry untied Draco and looked around, soon seeing Viktor swim by and free Hermione. The hour was almost up and there was still no sight of Fleur, so Harry freed the final hostage and began swimming to the surface. Just before he surfaces a bunch of grindylows attack him and he pushes Draco and Gabrielle to the surface. (Y'all know what happens to Harry next)

Draco gasps for air as he awoke in the middle of the black lake, next to him, a young girl trying to stay afloat. Draco wrapped one arm around her and began swimming her to the dock, where Fleur was waiting, ready to jump back into the water despite her injuries. "I've got her!" Draco called to her as he swam to the dock. Once at the dock he helped the young girl onto the dock before climbing on himself and looking around "where's Potter?" He asked. As if on cue Harry came flying out of the water by the wand and landed on the dock next to Draco coughing and gasping for air. Draco looked down at Harry, part of him wanted to rush to his side and make sure he was okay. Instead he took out his wand and magically dried himself before trying to disappear into the crowd, but before he could Harry grabbed his leg. Draco paused and looked down at Harry as the alpha stood up. "Why were you in the lake?" He asked.
"Thought I'd go for a swim in the middle of the night" Draco replied sarcastically.
"No, it doesn't make sense. Everyone else was supposed to rescue someone they loved and I had to rescue you-"
Narcissa Malfoy shoved her way out of the crowd and pulled Draco in close to her chest "oh my baby, you're safe" she says, holding her son close
"Mom I'm fine-"
"Your father is talking to the people in charge of the tournament, they have absolutely no right to be putting you in danger like that. You didn't sign up for this stupid tournament, it's unacceptable for them to use you as a part of this game"
"Mom, I was never in any real danger... If Potter hadn't rescued me I'm sure they still would have taken us out of the lake-" Draco glanced over at Harry "of course with his hero complex Potter just had to save everyone
