Visiting Spencer in jail is not how you thought you'd be spending your mornings. You brought him spare clothes each morning and took the used ones home to wash. You hated seeing him there, but at least it wasn't prison, not yet anyway...

Emily had found him a good lawyer, someone you both happened to know from your days bouncing around the globe as diplomat's children and she was one of the top defense attorneys in DC. "Thank you so much for doing this Fiona," You said into your hug with her after she had finished talking to Spencer,

"It's not a problem Y/N, and oh my gosh you are so grown up now!"

"Well I'd hope so, I am 33," you laugh and Fiona smiles,

"I'll be back later, there's a few paperwork things I have to get sorted, okay?" She adds and you nod yes and Fiona walks away.

You let out a long breath as Spencer is brought towards you with the guard, he smiles at you. How he could smile in this situation still baffled you, but you were thankful that he wasn't going insane, "Hey," He said, still smiling, he looked at the guard next to him and raised his eyebrows slightly at him and he nodded, a silent agreement between the two of them and then Spencer leaned in and kissed you on the cheek, "I would kiss you properly but my breath probably smells terrible."

You laugh, but longing for the feeling of his lips on yours and his arms wrapped around you, soon, you thought, and you would have now if you knew the guards wouldn't have stopped you, "Fiona will be back later, she just had some paperwork to do," You reply and Spencer nods,

"I think I have to go soon too..." He looks at the guard who remains expressionless, "How was Esmé's recital?"

"Terrible! She got up there and started stomping around the stage and when Mrs Denton went to get her off the stage she started saying that dancing is stupid and kids should have to learn math." You recall and you both laugh,

"That sounds like her, at least she'll love proper school when she's older. God, I miss them." He was smiling but his eyes were detached, in pain even if his mouth was trying to hide it,

"I know," You stroke his arm gently, the fibers of your skin gently catching on those on his sweater, "I'd bring them here if I thought it was a good idea," Spencer shook his head hard,

"No, no, please don't bring them here. I don't want them to see me like this."

"Time to go." The guard interrupted hoarsely and tugged Spencer's arm,

"I love you." He mouthed and you mouthed it back.

Not even an hour later, Fiona was back and so was Emily, "I just got off the phone with the AUSA, they're offering us a deal." She said as the three of you marched towards the room where Spencer would be able to speak to Fiona again. When you all got in the room, Fiona explained the Plea deal that the AUSA had offered, it took everything in you not to cry again, "They want me to plead guilty?" Spencer asked, confused, a rare occurrence,

"To involuntary manslaughter, the offer is two to five years," Fiona added, nodding,

"No!" Spencer blurted out angrily, "Fiona, I have two kids at home and-" He cut himself off, looking at you with mournful eyes, "I can't not be there for them for that long, I just can't. If I took it, by the time I got out Isaac probably wouldn't even know me and Esmé would be nearly nine! I can't do this, they're my kids, my family." He walked over to you and took your hands in his,

"It's a lot of time." Emily agreed,

"I understand, but it's all about perspective. It's a lot more than nothing, but a lot less than 25 to life which is what you'd be facing if convicted. That's a lot more time to be away from your kids, they'd be adults by the time you'd see them again," Fiona tried to reason,
