As promised Scott called Kayla later that night. Asher was in the living room, watching tv, and Scott had just finished doing the dishes. He rolled his wet selves up before dialing Kayla's, all too familiar, number.

"Scott? I didn't think you were actually going to call me back." Kayla says.

"I didn't do it for you." Scott says, leaning against his kitchen counter. "Why do you keep calling me?"

"I don't know how to tell you this, Scott." Kayla says, taking a deep breath in. "I'm taking you to court."

"What? Why?" Scott says. They were already divorced, what more could she want from him.

"Daniel and I have decided that we want Asher the majority of the time." Kayla says. "Plus I know something that makes me certain I would be a better full time caregiver."

"What are you talking about?" Scott says. He makes sure to keep his voice down so Asher can't hear him.

"I can't tell you that, my lawyer told me not to." Kayla says. "Just, call your lawyer Scott. I'll send you the court date once I know it."

Kayla ends the call and Scott just stands there. He doesn't know what to do. He thought divorce was the worst possible thing that would happen. Now she was trying to take his son away from him. Scott wasn't a bad father, she had no right to say he wasn't.

Scott stands still, staring at nothing in particular, for what feels like hours. Once he feels able to move again, Scott dials a number and puts the phone back to his ear. The person on the other end picks up after the second ring.

"Hey, Scotty."

"Mitch, can you come over?" Scott says. "I really need someone to talk to right now."

"I'll be there in ten minutes." Mitch says. "Are you ok?"

"I don't know."

"Ok, I'll be there soon." Mitch says. Scott hangs up and slides to the floor, letting his tears finally fall. He hated that this was effecting him so drastically. He just couldn't lose his son. Seeing him every other weekend just wouldn't be enough time.

Scott is still a crying mess when Mitch arrives. Scott doesn't even hear the doorbell, so Asher ends up answering the door.

"Hey, Buddy." Mitch says, crouching to Asher's level. "Do you know where your daddy is?"

"I think he's still in the kitchen." Asher says.

"Do you mind if I come in for a little bit?" Mitch asks. Asher shrugs and let's Mitch inside of the house. Mitch shuts the door behind him and makes a beeline to the kitchen, he can hear the muffled sobs as he gets closer. "Scotty, what happened?"

Scott looks up and then continues to cry. Mitch sits next to him on the floor and Scott lays his head in Mitch's lap. Mitch starts playing with Scott's hair while he waits for him to be ready to talk.

"She wants to take him from me." Scott says, wiping his eyes with his sleeve.

"What?"

"Kayla." Scott says. "She's taking me to court. Her boyfriend and her have decided that they want Asher the majority of the time."

"They can't just take him from you." Mitch says, anger finding him. "On what grounds does she think she'll do a better job?"

"Kayla won't tell me." Scott sighs. "I don't know what to do, Mitch."

"I'll be with you every step of the way." Mitch says. "Do you have a lawyer, it sounds like you'll need one."

"Not a very good one."

"Ok, I know a great one." Mitch says. "We'll start with that and then he can give us the next step. We can get through this Scott, I know we can."

"Thank you." Scott says. "I don't know what I'd do without you."

"You'd do the same for me." Mitch says. Scott sits up and they connect their lips in a short kiss. "I guess i'm just an amazing boyfriend."

"You are." Scott smiles. "You hungry? There are still leftovers from dinner."

"If it means spending more time with you then I guess I can eat."

"I was hoping you would say that." Scott smiles. With Mitch by his side Scott might just be able to get through this. All Scott knows right now is that he's not going down without a fight and he doesn't have to do it alone. Scott's ready to fight for his son, so that's what he'll do.
