Kyle Xavier was charged with attempted Murder. Which he, negotiated it to be attempted Manslaughter.
His team was working smoothly till two pieces of evidence changed everything.
While in police custody, Kyle was speaking with the police. The conversation went along the lines of...
Kyle: "I didn't want to kill him. I would never want to kill my son. I wanted to teach him a lesson. So I beat him."
Police: "But what if he died?"
Kyle: "I just wanted to beat him up not kill him."
Police: "certainly you knew he could die from how bad you beat him."
Kyle: "Yes, but it wasn't my intent. I intended to beat him not to kill him."
From this alone. Kyle ruined his case. This could no longer be looked at as Manslaughter. Kyle Xavier admitted to knowing that James could've died.
Then there was the recording that the Thompson's had of the whole encounter with Kyle and James.
Specifically, the moment when James cried out, "STOP! STOP IT! YOU ARE GOING TO KILL ME!"
The case was soon labelled as attempted murder in the second degree.
Kyle was incarcerated for over a year before his final sentence.
In that courtroom it was silent everyone was on edge. Kaitlyn and James held each other in anticipation. Neither of them knew what they wanted to happen to him, because once upon a time. Kyle was a loving husband. He was a caring father.
But now, he was a person that they don't recognize. He was said to have various mental illnesses. Like having split personalities as if he were schizophrenic.
Kyle has a handful of charges against him. For what he had done to his son and what he had done to his ex-wife in the past. The jury could either send him to a mental institution or prison. The wait for a decision was killing everyone.
Then reality struck.
"Has the jury made a verdict?" The judge said.
"Yes." Said a member of the jury.
"Please stand and tell the court what that verdict is."
"We the jury, found the defendant, Kyle Xavier, count one guilty of attempted Murder. Count two, guilty of aggravated assault. This is our verdict."
Kyle Xavier faces 37 years in prison. In due time he is to be retried to determine if he remains in prison for the rest of his life.
As everyone exited the courtroom. James' eyes met with Kyles. Kyle was a wreck. He was in tears.
Kyle mouthed a "sorry" to his son before being taken away.
...
It was a bit difficult for Kaitlyn and James to return to their ordinary lives. Everyone knew what happened to Kyle. The two got stares and they were talked about.
Soon enough it all drifted away.
James was able to move on a lot quicker with his friends at his side. His classmates forgot about the whole situation. The routine was coming back.
He was free. He was safe. James could live without restrictions with his mom.
