*SAKI UKU A RUBUCE CIKIN FUSHI*

_As-Salaam
Alaikum._

Malam, don Allaah ina da tambaya:

Yayana ne a cikin fushi ya rubuta wa matarsa saki uku, alhali suna da ’ya’ya guda biyu ƙanana. Daga baya kuma ya koma yana son ta, ita ma tana son sa. Shi ne aka yi saɓani: Wasu sun ce tun da a rana ɗaya ce ya yi sakin, to ya tashi a matsayin saki ɗaya ne! Wasu kuma sun ce, tun da dai rubutawa ya yi, to ya tashi a matsayin uku. Wai yaya abin ya ke?

*AMSA A113:*

_Wa Alaikumus Salaam Wa Rahmatul Laah Wa Barakaatuh._

Wannan ya ƙunshi magana a kan abubuwa guda uku ne, kamar haka:

*[1] Saki a cikin Fushi.*

Malamai sun kasa fushi nau’i biyu ne.
Akwai wanda kodayake yana cikin fushi, amma fa yana sanin duk abin da yake faɗi, to shi kam sakinsa ya auku, kuma za a tabbatar masa da shi. Amma wanda fushinsa ya yi tsanani ta yadda har ba ya iya gane irin abubuwan da yake faɗi ko yake aikatawa, wannan sakinsa bai auku ba saboda maganar Annabi _(Sallal Laahu Alaihi Wa Alihi Wa Sallam)_ da muka kawo a cikin amsar tambaya ta *A111* , cewa:

لَا طَلَاقَ وَلَا عِتَاقَ فِي إِغْلَاقٍ
Babu saki ko ’yantawa a cikin rufewar hankali ko tilasci.

A amsar tambaya ta *A039* mun ambaci cewa: Malamai sun yarda cewa: Wanda ya rubuta wa matarsa saki, to sakin ya tabbata matuƙar dai ya yi niyyar hakan. Haka aka riwaito daga Al-Hasanul Basariy, da Sha’abiy, da Qataadah, da Abu-Haneefah, da Maalik, da Shaafi’iy, da Laith Bn Sa’ad da sauransu. _(Al-Muhallaa: 11/514)._

Wannan kuma yana daga cikin nau’in saki sarihi ne, wanda ba ya ɗaukar tawili. Sai fa idan ya yi da’awar cewa ba sakin yake nufi ba, kawai dai yana ƙoƙarin gwadawa da kyautata rubutunsa ne cewa: Matarsa wance sakakkiya ce! A nan wasu malamai irin su As-Shaikh Uthaimeen _(Raahimahul Laah)_ a cikin *As-Sharh Al-Mumti’: 5/465* suna ganin sakinsa bai auku ba.

*[3] Saki Uku.*

Mun ambata a cikin amsar tambaya ta *A111* cewa:

Saki uku, ɗaya ne daga cikin sakin bidi’a idan aka aukar da shi a lafazi guda ko kuma aka maimaita shi a mazaunin guda. Game da aukuwarsa kuwa malamai sun yi saɓani mai tsanani. Amma mafi kyau daga cikinsu shi ne cewa: Ya auku a matsayin saki guda ɗaya ne wanda ake iya yin kome a cikin iddarsa. Domin haka abin ya ke a zamanin Manzon Allaah _(Sallal Laahu Alaihi Wa Alihi Wa Sallam)_ da Abubakar da farkon zamanin Umar _(Radiyal Laahu Anhumaa)._

Kuma abin da ya auku a ƙarshen zamanin Umar _(Radiyal Laahu Anhu)_ na mayar da saki-uku a matsayin uku, ijtihadi ne daga gare shi _(Radiyal Laahu Anhu),_ wanda kuma a wurin malamai muhaƙƙiƙai bai isa dalili ƙaƙƙarfa da har zai iya kawar da hukuncin da aka sani a farkon zamaninsa, wanda kuma ya dace da hukuncin da aka sani a zamunnan da suka gabaci na sa ba. Dubi yadda aka tattauna matsalar a cikin littafin *Nizaamut Talaaq* na Ahmad Shaakir _(Rahimahul Laah)._

Don haka, daga hasken waɗannan maganganun muna iya fahimtar cewa:

(i) Idan dai nau’in fushin da ya ɗauki wannan mutumin har ya rubuta takardar fushi ne mai tsanani, to ba za a ce sakin aurensa ya auku ba, _in shaa’al Laah._

(ii) Idan kuma ba mai tsanani ba ne, to sakin da ya rubuta za a ɗauke shi, a magana zaɓaɓɓiya a wurin malamai cewa, saki ɗaya ne wanda yake iya yin kome a cikinsa.

A ƙarshe dai, kamar yadda muka faɗa a ƙarshen amsar tambaya ta *A111:*

Lallai mu san cewa: Hukuncin Alƙali shi yake yanke dukkan rikici a tsakanin al’umma. Don haka, in dai akwai wanda yake da ra’ayin cewa saki uku uku ne a cikin masu jayayya, to ba yadda za a yi sai dai a ɗauki maganar zuwa gaban alƙalin musulunci, don ya yanke musu hukunci a ƙarƙashin *Al-Kitaab Was Sunnah Alaa Fahmi Salaf As-Saalih*
